The reasons for proposing to impose a
financial penalty are as follows:
Mrs Parvez is the registered proprietor of 28 Paddock Grove, Boston
with her husband (Mr Parvez) managing the property. Her property
portfolio indicates that she is running a business generated from
rental income and therefore have been deemed just as culpable as Mr
Parvez in the offence.
Mr Parvez was informed of the requirements relating to HMO's and
the licensing thereof during discussions that took place from July
2021 and given the present occupation level at 28 Paddock Grove,
Boston an offence under section 72 of the Housing Act 2004 has been
committed.
Throughout October 2021 there were six occupants in situ forming
two households (three sets of couples with two of these sets being
related).
On the 1 7th of February 2022, the number of occupants were the
same with a different couple occupying the premises.
Within the last 12 months it has been evidenced on 2 occasions that
the property has been occupied as a HMO. The Housing Standards Team
has offered guidance on the requirements and expectations of a
landlord at each stage of the process. Despite receiving this
guidance there has been no clear commitment to either ensure that
the property is being operated as a single dwelling, or to licence
it with the Council as a HMO.
As the owner and person who financially benefits from the premises
known as 28 Paddock Grove, Boston Mrs Parvez has been deemed (under
the Housing Act 2004) as a 'person having control'. For this
reason, it has been deemed appropriate to serve this Final Notice
to Issue a Financial Penalty on her.
Prosecution was considered.
