10.

DECLARATION OF INTERESTS

To receive declarations of interests in respect of any item on the agenda.

Minutes:

Councillors David Brown, Sue Ransome, Colin Brotherton and Alison Austin declared for clarity that they were members of the SELLP which was referenced within planning application B 16 0463.  

Each member confirmed they had no conflict in respect of determining the application

 

Councillor Alison Austin declared that due to a recent conversation with Mr Sharpe in respect of the exempt item on the agenda, she felt that the conversation could be misinterpreted and as such, for transparency on the deliberation of the item, she would exempt herself from the meeting at that point in the proceedings and take no part in the item.

 

Councillor Claire Rylott declared that having spoken as Ward Member for the application under consideration within the exempt item, at the initial tabling of that application at the Planning Committee on the 10th January 2017, she would exempt herself from the meeting at that point in the proceedings and would take no part in the item.

The Development Control Manager addressed the committee and advised that the normal practice of issuing notifications of the tabling of the application at the meeting had not been followed. He sought committee’s agreement to defer the item until the next scheduled meeting. 

 

The Development Control Manager offered his sincere apologies for the error and reassured the committee that the issue had been addressed and steps taken to ensure there would be no repetition.

 

It was moved by Councillor Michael Cooper and seconded by Councillor Paul Skinner that the item be deferred in line with the officer request and that it be tabled at the next scheduled meeting of the committee on Tuesday 16th May 2017.

 

Vote:     In Favour:   11.      Against:    0.       Abstentions:     0.

 

RESOLVED:  That committee agree that the application be deferred in line with the Officer request to enable the correct procedures to be carried out in respect of public notification of the scheduling and that the application be re-submitted at the next scheduled meeting of the planning committee on Tuesday 16th May 2017.

APPEAL DECISION

Minutes:

The Development Control Manager presented the report which identified the appeal decision in respect of an outline planning application for 29 dwellings on Clampgate Road in Fishtoft, which had been refused under delegated powers.

 

The committee were advised that the three reasons for refusal had been upheld by the Inspector, one of which had been the failure to provide pre-determination archaeological evaluation which was a rare reason for refusal but it was reassuring to see it supported by the Inspector.

 

Further appeal decisions were to be tabled at the planning meeting in May 2017 which would conclude the appeal performance for the year which looked likely to exceed the target figure of 20%.

 

RESOLVED:  That committee received and noted the report.

Minutes:

Members noted the list and referenced an application and a member sought confirmation on the reasons for refusal of roller shutters on town centre premises, referencing two items within the list where external sholler shutters had been refused.

 

The Development Control Manager advised that an applicant needed to justify the reason for a request for solid shutters.  A wide range of security options were available for business frontages, particularly those in the Conservation area, which would preserve and enhance the look of the area and not detract from it.  Officers were always available to offer advice on the options available which were now detailed in the draft Shop Front Design Guide which was presently the subject of consultation.

 

RESOLVED:  That committee received and noted the report.

EXCLUSION OF THE PUBLIC AND PRESS

To consider resolving - That under Section 100(A)(iv) of the Local Government Act 1972, as amended by the Local Government (Access to Information) (Variation) Order 2006, the public and press be excluded from the meeting for the following items of business on the grounds that it involves the likely disclosure of exempt information as defined in paragraph 5 of Part 1 of Schedule 12A of the Order.

Minutes:

Committee unanimously agreed to move into exempt measures to receive the report.
