Application for the transfer of a Premises Licence

 

 

The Parties:

 

The Licensing Sub-Committee convened to consider an application for the transfer of a premises licence where an objection has been received.

 

At the hearing the Sub-Committee heard from Anna McDowell (Senior Licensing Officer), Ms McDowell advised the Sub-Committee that during the period between the objection being received, and the date of the hearing, the original applicant had advised of the impending sale of the business. Following this the new company director was asked to provide documentary evidence of their purchase of the business and subsequently provided documents including a new lease agreement, contract of sale, and proof of payment of the first months' rent.

 

Taking the new information into consideration, Lincolnshire Police have advised that whilst they have concerns regarding the timings and timeline of the change of directors, the legitimacy of the sale, and whether the original applicant would have nothing more to do with the premises, that following these submissions they do not have exceptional concerns with the new director and therefore withdraw their objection.

 

In line with the requirements of the Act where an objection is withdrawn later than 24 hours before the day on which the hearing is to be held it must be withdrawn at the hearing and the Sub-Committee therefore determined to dispense with the hearing and accept that the application is automatically granted.
