Councillor David Middleton advised that comments made at a previous meeting of Frampton Parish Council had suggested that he was acquainted with the applicant and supportive of the application. Councillor Middleton confirmed that this was not the case, that he did not know the applicant, had never met the applicant and had never visited the premises. He further confirmed that his decision on the application would be based solely on the officer advice and the information presented and discussed during the meeting. |

Proposal: Change of use of part warehouse to adult entertainment and drinking establishment (Sui Generis) including outdoor areas and proposed construction of wall and timber canopy structure
Site: Marsh Farm Cottage, Frampton Roads, Frampton, Boston, PE20 1AY Additional documents: Minutes: Application Type: Full Planning Permission Proposal: Change of use of part warehouse to adult entertainment and drinking establishment (Sui Generis) including outdoor areas and proposed construction of wall and timber canopy structure Site: Marsh Farm Cottage, Frampton Roads, Frampton, Boston PE20 1AY The Chairman introduced the application and invited the Senior Planning Officer to present the report. The Senior Planning Officer presented the application and advised that planning permission was sought for the extension and regularisation of an existing approved commercial use at Marsh Farm Cottage, Frampton. Members were informed that the proposal related to additional areas of an existing warehouse building, including a first-floor area, together with the use of the outdoor swimming pool area, covered pergola structure and associated external facilities. As a preliminary matter, Members were advised that the Council’s Environmental Health Team had recently received a complaint relating to the site. However, the complaint remained under investigation and Environmental Health had confirmed that it did not alter its consultation response or recommendation. Members were further advised that discussions with the applicant's agent had clarified the intended operating hours of the premises. Consequently, an amendment was proposed to Condition 3 so that opening hours would be restricted to 11.00am to 10.00pm Monday to Thursday, 11.00am to 2.00am on Fridays and Saturdays, and 11.00am to 10.00pm on Sundays and Bank Holidays. Environmental Health had confirmed that it had no objection to the revised hours. Members were advised that the restriction on any outdoor activities and the playing of music outdoors would remain in place, with external activities continuing to be subject to stricter controls. The Committee was reminded that building regulations and licensing matters were subject to separate regulatory regimes and were not planning considerations. Likewise, Members were advised that historic matters, personal opinions regarding the nature of the business and wider moral considerations should not form part of the determination. The application was required to be assessed solely against planning policy and other material planning considerations. A detailed presentation was then provided outlining the planning history, site context and surrounding land uses. This included aerial and roadside photographs, site plans and photographs of the existing buildings and surrounding area. Members were advised that the principle of the use of the site had already been established through planning permission B/23/0417 and that the application before the Committee did not seek to introduce a new use, but rather to extend the area in which the approved use could operate. The site occupied a rural location approximately 1.7 miles from Frampton village and comprised part of a former agricultural warehouse building together with associated external areas. The surrounding area was characterised by open agricultural land and dispersed residential properties. The nearest properties were identified, including their proximity to the site. Members were also advised of the geographical relationship between the site, Frampton Marsh Nature Reserve and The Wash Site of Special Scientific Interest (SSSI).
