Public Space Protection Order (PSPO) "Alcohol" Review

Boston Borough Council’s Public Space Protection Order (in relation to Alcohol) commenced on Monday 12th January 2015.

It is a statutory requirement that a public space protection order may not have effect for a period of more than 3 years, unless extended by the local authority responsible for granting the original order.

Boston Borough Council’s Public Spaces Protection Order (Alcohol) currently expires on 11th January, 2027.

A local authority making a PSPO may extend the period for which it has effect if satisfied on reasonable grounds that doing so is necessary to prevent – (a) occurrence or recurrence after that time of the activities identified in the order, or (b) an increase in the frequency or seriousness of those activities after that time.

An extension may not be for a period of more than 3 years and must be published in accordance with regulations made by the Secretary of State.
